Recent trends in Chinese foreign investment rules, and their impact on M&A transactions
In March 2019, the National People’s Congress (NPC) adopted the new Foreign Investment Law, which aims at replacing by early 2020 the current regulations on joint ventures and WFOEs and unifying the legal regime of all enterprises under the PRC Company Law. As an increasing number of Chinese private enterprises become the target of foreign companies’ acquisition projects: what to expect from the new rules?
